After an Accident
How long do I have to file a personal injury case?

In California, most personal injury cases must be filed within two years. Claims against government entities may have shorter deadlines, so it’s best to speak with an attorney as soon as possible.

If you were a passenger and the driver was at fault, you may still be able to pursue compensation through the driver’s insurance.

Hiring an attorney

Medical treatment
Possibly. While it’s always best to seek medical attention as soon as possible, delaying treatment doesn’t automatically prevent you from recovering compensation. The circumstances of your case matter, so contact us as soon as possible to discuss your options.

The settlement process can take time due to factors such as medical treatment, insurance negotiations, and case evaluation. While waiting can be frustrating, taking the necessary steps can help maximize your recovery. An experienced attorney will work to keep your claim moving forward and protect your best interests.
Fees & Costs

Insurance

A statement can hurt your case. Anything you say may be recorded and used during settlement negotiations.
Before speaking with the insurance company, talk to a lawyer. Insurance adjusters work for the insurer and aim to protect the company’s interests—not yours.

If your policy includes collision coverage, filing through your own insurance can often be the quickest way to get your car repaired. The other driver’s insurance may take time to investigate and accept responsibility. If the accident is determined not to be your fault, your insurance company may recover the costs and reimburse your deductible.

You may still be able to recover compensation for medical bills and property damage, but California law can limit your ability to recover pain and suffering damages. For added protection, consider carrying uninsured/underinsured motorist (UM/UIM) coverage on your policy.

If you are not at fault for the accident, your rates generally should not increase. Having an attorney handle the injury portion of your claim may help move the liability process along. Your insurance coverage, including property damage, uninsured/underinsured motorist, or medical payments coverage, may also help protect your claim.
